In addition, because your business uses a trade name, namely, "Wagon Train T-Shirts," you need to obtain a fictitious business name certificate with that name registered on the certificate.

However, you can also set up an LLC for your business and that would be much better for your t-shirt business because if, for example, the tshirt retail street cart rolls down and damages property or injures individuals, you will be liable for all damages and injuries.

If your business has no money to pay, they will go after your personal assets such as your luxury car or nice house to satisfy the judgements.

As you can see, it is better to form an LLC for your tshirt business.

Note that your tshirt cart fall in the category of a vending booth.

In Florida, tshirts carts are regulated, and the rules provide that a "vending booth" is a temporarily wheeled cart-mounted food or retail establishment located on public property or a permanent structure.

A vending booth cannot be propelled by an internal combustion engine, electric motor or other similar mechanical device.
